1. Information We Collect

Information You Provide Directly

When you create an account, join our waitlist, place an order, or apply as a cook, we may collect:

• Full name
• Email address
• Phone number
• Mailing address and delivery address
• Profile photo (optional)
• Account login credentials (email and password, managed through our authentication provider)

Information from Home Cooks

If you apply as a home cook on PlateSend, we additionally collect:

• Business name
• MEHKO permit number and enforcement agency name
• Cuisine types and menu information
• Service area (zip codes)
• Food photos
• Bank account and identity information required for payment processing (collected and stored by Stripe, not by PlateSend directly)

Information Collected Automatically

When you access the Platform, we may automatically collect:

• IP address
• Browser type and version
• Device type and operating system
• Pages visited, time spent, and referring URLs
• General geographic location (city/region level, not precise location)

Information from Third Parties

We may receive information from third-party services we integrate with, including Stripe (payment confirmation and payout status), Twilio (SMS delivery status), and Supabase (authentication data).

2. How We Use Your Information

We use the information we collect to:

• Create and manage your account
• Process food orders and facilitate transactions between customers and home cooks
• Process payments and facilitate cook payouts
• Send order status notifications via SMS and email
• Verify MEHKO permits and enforce platform compliance with California food safety regulations
• Respond to food safety complaints and cooperate with enforcement agencies as required by law
• Provide customer support
• Send you important service-related communications
• Improve and maintain the Platform
• Detect and prevent fraud or abuse
• Comply with legal obligations, including IFSI reporting requirements under California Retail Food Code Chapter 11.6

3. How We Share Your Information

We do not sell your personal information. We share your information only in the following circumstances:

Between Cooks and Customers

When you place an order, we share relevant information between the customer and cook to fulfill the order. Customers will see the cook's business name, MEHKO permit number, enforcement agency, and food listings. Cooks will see the customer's name, delivery address (if applicable), phone number, and order details.

Service Providers

We share information with third-party providers that help us operate the Platform:

• Stripe — processes payments and manages cook payouts. Stripe collects and stores payment card information directly; PlateSend does not store your credit card numbers. Stripe's privacy policy governs their use of your data.
• Twilio — sends SMS order notifications to your phone number. Twilio processes your phone number and message content to deliver texts.
• Supabase — provides our database and authentication infrastructure. Stores account data on our behalf.
• Vercel/Netlify — hosts our website and application.

Legal & Regulatory

We may disclose your information when required by law, regulation, or legal process, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others. This includes sharing information with California state or county health authorities as required under IFSI regulations.

Business Transfers

If TAMD LLC is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

4. Payment Processing

PlateSend uses Stripe to process all payments and cook payouts. When you make a purchase or set up payouts as a cook:

• Your payment card information is collected and stored directly by Stripe — PlateSend never sees, stores, or has access to your full credit card number
• Stripe may collect additional identity verification information from cooks to comply with financial regulations (Know Your Customer / Anti-Money Laundering)
• Payment transaction data (amounts, dates, order references) is shared between Stripe and PlateSend to manage orders and payouts

Stripe's collection and use of your data is governed by Stripe's Privacy Policy.

5. SMS & Text Messages

PlateSend uses Twilio to send SMS text messages for order-related notifications. By providing your phone number and placing an order (or accepting an order as a cook), you consent to receive text messages from PlateSend, including:

• Order confirmation messages
• Order status updates (accepted, cooking, ready for pickup, delivered)
• Important service alerts related to your orders

Your phone number is shared with Twilio solely for the purpose of delivering these messages. We do not use your phone number for marketing texts unless you separately opt in.

6. Cookies & Analytics

We may use cookies and similar technologies to:

• Keep you logged in to your account
• Remember your preferences
• Understand how you use the Platform (analytics)
• Improve performance and user experience

You can control cookies through your browser settings. Disabling cookies may affect certain features of the Platform. We do not use cookies for third-party advertising.

7. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our services. We may also retain certain information as required by law (including IFSI record-keeping requirements), to resolve disputes, enforce our agreements, or for legitimate business purposes.

If you request account deletion, we will delete or anonymize your personal information within 30 days, except where we are legally required to retain it. Order history and transaction records may be retained for up to 7 years for tax and regulatory compliance.

8. Your Rights & Choices

You have the following rights regarding your personal information:

• Access — Request a copy of the personal information we hold about you
• Correction — Request that we correct inaccurate information
• Deletion — Request that we delete your personal information, subject to legal retention requirements
• Opt-out of SMS — Reply STOP to any text message to stop receiving SMS notifications
• Account closure — Close your account at any time by contacting us

9. Data Security

We implement appropriate technical and organizational measures to protect your personal information, including encryption of data in transit (HTTPS/TLS), secure authentication through Supabase, and role-based access controls within our platform.

However, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your data. You are responsible for keeping your account credentials confidential.

10. Children's Privacy

PlateSend is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from children. If you believe a child under 18 has provided us with personal information, please contact us and we will promptly delete it.

11. California Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), including:

• The right to know what personal information we collect, use, and disclose
• The right to request deletion of your personal information
• The right to opt out of the sale of your personal information (we do not sell personal information)
• The right to non-discrimination for exercising your privacy rights

12. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by posting the updated policy on the Platform and updating the "Effective Date" at the top. Your continued use of PlateSend after any changes constitutes your acceptance of the updated policy.
